By accessing and using Qocial, you accept and agree to be bound by the terms and provision of this agreement.

1. Acceptance of Terms

By using Qocial, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our service.

2. Description of Service

Qocial offers two services:

2.1 Family Social Network

• Family tree creation and management
• Private connections between family members and relatives
• Peer-to-peer messaging and communication (no data stored on our servers)
• Sharing of photos and content within your private family network

Only family members and relatives you connect with can access your shared content. We do not store your family data on our servers.

2.2 Business Listing Service

• Discovering and browsing local businesses
• Adding and managing business listings (name, address, contact, description, images, hours, products, menus, etc.)
• Writing and editing reviews and ratings
• Search and discovery by category, location, and tags
• Business claiming and verification
• Premium features and subscriptions (if applicable)

Business listings and reviews are public and visible to all users. They are stored on our servers.

3. User Accounts

To use Qocial (family network or business listings), you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate information to connect with your family
• Notifying us immediately of any unauthorized use

4. Content and Data

4.1 Private Family Content

Private by Design: Family tree data, messages, photos, and communications are shared only with the family members and relatives you connect with. We do not store this data on our servers, and it is never shared with any other person.

4.2 Public Business Listing Content

IMPORTANT: All business listings, reviews, ratings, and related content you add are public and visible to all users. This includes:

• Business name, address, contact details, description, images
• Products, menus, business hours
• Reviews and ratings you write

By adding a business or writing a review, you acknowledge that this content will be stored on our servers and displayed publicly. You are solely responsible for the accuracy and legality of the content you post.

5. Content Guidelines

You agree not to post content that:

• Is illegal, harmful, threatening, abusive, or defamatory
• Violates any intellectual property rights
• Contains spam, malware, or malicious code
• Is false, misleading, or deceptive
• Promotes violence, discrimination, or hate speech
• Contains personal information of others without consent

6. Payment Terms and Refund Policy

NO REFUNDS POLICY: All payments made to Qocial, including but not limited to business listing fees, premium features, and subscription charges, are final and non-refundable.

By making a payment, you acknowledge that:

• You understand and agree to our no-refund policy
• All charges are final once processed
• We do not provide refunds for change of mind, technical issues, account suspension, or business closure

7. Intellectual Property

Family content: You retain ownership. You grant Qocial only the limited license necessary to facilitate peer-to-peer connections. We do not use, display, or distribute your family content beyond enabling your private connections.

Business Listing content: You retain ownership of content you create, but grant Qocial a worldwide, non-exclusive, royalty-free license to use, display, and distribute your business listings, reviews, and related content in connection with our service (e.g., displaying them publicly to users).

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we handle information:

• Family network: We do not store your family data on our servers. Your family content is shared only with your connected relatives.
• Business Listings: Business listings, reviews, and ratings are stored on our servers and are public. All users can see them.

9. Limitation of Liability

Qocial shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

10. Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms. Upon termination, your right to use the service ceases immediately.

12. Changes to Terms
